It took two weeks before the pre trial took place and the Williams wasn't even in court that day their lawyers were and tried to get the five counts of murder and one count of attempted murder dropped. Their lawyers stated that they couldn't charge them with the death of Mrs.

​Fitzgerald's baby as an actual murder or even attempted murder and that is when Karla argued to Judge Jarret that farther in the trial all and everything that she had charged them with would be proven without a shred of doubt so the trial was still on the go. It took another couple of weeks to pick the jury. Of couse the defense wanted his client's party to be on the jury so the prosecutor had to allow more of them than the other party but did find a few that stated they had never voted or claimed to be either party. Karla felt that she had a fairly reliable jury The first piece of evidence was a lab report that Mrs. Fitzgerald was difinately was pregnant and the state law said if a woman that was killed pregnant then her unborn child could be listed either way that the prosecution wanted to
